2. The offers on www.pokecard.store are non-binding. The stock levels stated on www.pokecard.storeand the actual stock levels may differ. Incorrect price information cannot be ruled out.

3. A contract is concluded when the customerplaces an orderonwww.pokecard.store. 15 Trading GmbHis entitled to terminate the contract in the event of an incorrect price quotation or an incorrect display of stock levels. In this case, the customer will be refunded the amount paid. The successful conclusion of a contract is binding and the customer cannot withdraw from it.

4. No guarantee is given regarding the release date for pre-orders. This date is communicated to us by our supplier. The latest information regarding the expected release date is always available at www.pokecard.store. Orders cannot be canceled by the customer due to a delayed release date/delays on the part of the supplier. 

5. in the case of pre-orders, the expected quantities may be reduced by our supplier. If this is the case and not all pre-orders can be fulfilled, the contract will be terminated and the customer will be refunded the amount paid. The principle here is that the most recent pre-orders are cut first. If our quantity has been reduced by the supplier by more than 50%, we will distribute the reductions as fairly as possible among all customers at our own discretion.

6. By placing an order, the customer declares that they understand and agree that prices may fluctuate due to changes in the purchasing and market conditions of 15 Trading GmbH’s suppliers. This applies in particular to Japanese pre-orders and new releases, whose prices may be subject to significant fluctuations before and shortly after their release. Public statements of fact that are untrue and allege that 15 Trading GmbH is responsible for these fluctuations may, depending on their nature, constitute an unlawful infringement of personal rights within the meaning of Art. 28 of the Swiss Civil Code (ZGB) or the Swiss Criminal Code (StGB).

7.Ifthe item is in stock, the delivery time varies depending on the selected shipping method. We use Swiss Post for delivery. Orders are processed and shipped on business days, Monday through Friday (excluding holidays).

8.Theshipping costs are as listed on the order.

9. 15 Trading GmbH is not liable for damage caused during transit by the carrier (e.g., the postal service). The customer is obligated to report any visible damage caused during transit to the delivery agent immediately. If a shipment is shown as delivered according to the carrier’s tracking information but cannot be located by the customer (e.g., theft or loss at the delivery location), the customer is entitled to a replacement or refund only if the “Priority Signature + Assurance” shipping option was selected when the order was placed.

10. personal customer data will be treated confidentially and will not be passed on to third parties unless necessary for the processing of payment and delivery. Customers also have the option of registering voluntarily for SMS marketing. The cell phone number provided by the customer is used exclusively for sending marketing and service messages (e.g. information on products, offers, promotions and events). It is possible to unsubscribe at any time by following the instructions given in the SMS or by sending a message to support at pokecard.store.

11. The customer may cancel a purchase agreement in writing within 5 business days, provided a valid reason is given. In cases where cancellations are exceptionally permitted, Pokecard Store may deduct 7% of the purchase price to cover payment and processing fees. Canceling pre-orders may result in exclusion from future pre-orders. 

12.Returnsare accepted within 7daysof receiving the shipment, unless the product page explicitly states that the item cannot be returned. Returns must be requested in advance by emailing support@pokecard.store.

13. only items in their original packaging, unused, clean, fully returned and undamaged will be accepted for return. The amount paid will only be refunded after receipt and inspection of the return.

14. individual tickets cannot be returned.

15.The customer is responsible for return shipping costs. For costs already incurred by 15 Trading GmbH, 15% of the order value will be deducted from the refund. 

16 The website is translated from German into English and French and is available in these languages. It cannot be ruled out that errors may occur in the translation. The original German text shall prevail in the event of disputes.

17. MF Group / POWERPAY, as an external payment service provider, offers the “Purchase on Account” payment method. With this option, customers can conveniently pay for their online purchases via invoice. If payment is not made within the specified time frame, a monthly invoice summarizing the outstanding orders will be sent the following month. Upon conclusion of the purchase agreement, POWERPAY assumes the resulting receivable and independently handles the corresponding payment arrangements. By selecting “Purchase on Account,” the customer accepts POWERPAY’s Terms and Conditions in addition to our own Terms and Conditions. These are available at: powerpay.ch/de/agb

18. Creatingmultiple accounts to gain an advantage or to abuse discount promotions is prohibited. We reserve the right to cancel orders and charge customers for any resulting payment fees.

19. if the customer's address is incorrect and additional costs are incurred as a result, the customer must bear these additional costs.

20. If an order must be reversed for reasons attributable to the customer (e.g., violation of order limits, circumvention of system restrictions, refusal to undergo a required identity verification in cases of objective suspicion of fraud, failure to pick up the order within 7 days, or incorrect loyalty status), 15 Trading GmbH may charge the actual payment fees incurred as well as a reasonable administrative fee. These deductions shall not exceed 7% of the order value.

21. Orders must be picked up within 7 days of receiving confirmation that the order is ready for pickup. If the customer fails to pick up the order, 15 Trading GmbH may cancel the order at the customer’s expense.

22. If there are objective indications of an increased risk of fraud or abuse (e.g., an unusually high order value, a discrepancy between the billing and shipping addresses, international payment methods, or technical anomalies in the payment process), 15 Trading GmbH may require proof of identity, card ownership, or the shipping address before shipping the order. If the customer fails to cooperate within a reasonable period of time, 15 Trading GmbH is entitled to rescind the contract.

23. 15 Trading GmbH places great importance on offering products at fair prices to collectors and gamers. To ensure this, 15 Trading GmbH reserves the right to cancel orders in whole or in part if there are objective indications that the customer is purchasing the ordered products primarily for the purpose of commercial resale (e.g., as a reseller, scalper, or TCG shop). If an order must be canceled for these reasons, 15 Trading GmbH is entitled to deduct the actual payment fees incurred, as well as a reasonable administrative fee, from the refund amount. The total deductions shall not exceed 7% of the order value.

24. Automated access to our website (in particular through crawling, scraping, or similar technical means) is not permitted without prior express authorization. In the event of violations, 15 Trading GmbH reserves the right to exclude the user in question from the newsletter and the loyalty program.

25. Coupon codes and discounts generally do not apply to sale items, pre-orders, and single tickets. Discounts generally cannot be combined with one another. This applies to items already on sale, coupon codes, Trainer Points, and any other forms of discounts.

26. If a customer violates any of the General Terms and Conditions or the restrictions on orders specified in the product description, 15 Trading GmbH may prohibit that person from placing future orders (blacklist).

28. The exclusive venue for legal proceedings is Zurich, ZH. The legal relationship is governed by Swiss law.
